What a warning letter is, and why it matters

A warning letter is FDA’s notice to a company that the agency believes it has found significant violations of federal requirements. It usually follows an inspection and a Form 483, after FDA has reviewed the firm’s response and found it inadequate, though letters also follow sample testing, website reviews and import examinations.

The letter lists each violation, often with the 21 CFR section, explains why the firm’s response fell short, and asks for a written reply within 15 working days describing corrections and how they will be prevented from recurring. Unresolved problems can lead to import alerts, seizures, injunctions or held approvals.

For buyers, investors and quality teams, a warning letter is a clear signal about a site’s compliance status, and the letter’s wording shows exactly where FDA drew the line.

Questions

What is an FDA warning letter?

A warning letter is FDA’s formal notice that it believes a company has significantly violated federal requirements. It asks the firm to respond in writing, usually within 15 working days, with corrections and preventive actions.

What is the difference between a 483 and a warning letter?

A 483 lists an investigator’s observations at the end of an inspection and is not a final decision. A warning letter is an agency-level action, issued after FDA reviews the evidence and the firm’s response.

How does a warning letter get closed?

After the firm corrects the violations and FDA verifies them, often through a follow-up inspection, FDA may issue a close-out letter.

Can a warning letter affect product approvals?

Yes. Unresolved violations can delay or block approvals, lead to import alerts and affect government contracts.
